Authoritarianism and Democracy in Europe, 1919-39 Comparative Analyses
D. Berg-Schlosser, J. Mitchell, "Authoritarianism and Democracy in Europe, 1919-39: Comparative Analyses"
English | 2002 | pages: 360 | ISBN: 0333966066 | PDF | 2,4 mb
Authoritarianism and Democracy in Europe, 1919-39 offers a comprehensive analysis of the survival or breakdown of democracy in interwar Europe. The contributors explore factors such as the historical, social-structural and political-cultural backgrounds of the policies that European countries attempted to implement to counter the world economic crisis of 1929. The analysis serves as an important backdrop for the assessment of current democratic developments in former communist Europe and highlights some of the problems and risks involved in the transition process.

E-BooksThe Comparative Politics of Education Teachers Unions and Education Systems around the World

The Comparative Politics of Education Teachers Unions and Education Systems around the World
Terry M. Moe, "The Comparative Politics of Education: Teachers Unions and Education Systems around the World "
English | ISBN: 1107168880 | 2016 | 372 pages | PDF | 2 MB
Public education is critically important to the human capital, social well-being, and economic prosperity of nations. It is also an intensely political realm of public policy that is heavily shaped by power and special interests. Yet political scientists rarely study education, and education researchers rarely study politics. This volume attempts to change that by promoting the development of a coherent, thriving field on the comparative politics of education. As an opening wedge, the authors carry out an 11-nation comparative study of the political role of teachers unions, showing that as education systems everywhere became institutionalized, teachers unions pursued their interests by becoming well-organized, politically active, highly influential - and during the modern era, the main opponents of neoliberal reform. Across diverse nations, the commonalities are striking. The challenge going forward is to expand on this study's scope, theory, and evidence to bring education into the heart of comparative politics.

E-BooksComparative Company Law A Case-Based Approach Ed 2

Comparative Company Law A Case-Based Approach Ed 2
Mathias Siems, "Comparative Company Law: A Case-Based Approach Ed 2"
English | ISBN: 1509909362 | 2018 | 584 pages | PDF | 3 MB
As attention moves rapidly towards comparative approaches, the research and teaching of company law has somehow lagged behind. The overall purpose of this book is therefore to fill a gap in the literature by identifying whether conceptual differences between countries exist. Rather than concentrate on whether the institutional structure of the corporation varies across jurisdictions, the objective of this book will be pursued by focusing on specific cases and how different countries might treat each of these cases. The book also has a public policy dimension, because the existence or absence of differences may lead to the question of whether formal harmonisation of company law is necessary.

E-BooksConstitutional Courts as Positive Legislators A Comparative Law Study

Constitutional Courts as Positive Legislators A Comparative Law Study
Constitutional Courts as Positive Legislators: A Comparative Law Study By Allan R. Brewer-Carias
2011 | 962 Pages | ISBN: 1107613086 | PDF | 15 MB
In all democratic states, constitutional courts, which are traditionally empowered to invalidate or to annul unconstitutional statutes, have the role of interpreting and applying the Constitution in order to preserve its supremacy and to ensure the prevalence of fundamental rights. In this sense they were traditionally considered "negative legislators," unable to substitute the legislators or to enact legislative provisions that could not be deducted from the Constitution. During the past decade the role of constitutional courts has dramatically changed as their role is no longer limited to declaring the unconstitutionality of statutes or annulling them. Today, constitutional courts condition their decisions with the presumption of constitutionality of statutes, opting to interpret them according to or in harmony with the Constitution in order to preserve them, instead of deciding their annulment or declaring them unconstitutional. More frequently, Constitutional Courts, instead of dealing with existing legislation, assume the role of assistants or auxiliaries to the legislator, creating provisions they deduct from the Constitution when controlling the absence of legislation or legislative omissions. In some cases they act as "positive legislators," issuing temporary or provisional rules to be applied pending the enactment of legislation. This book analyzes this new role of the constitutional courts, conditioned by the principles of progressiveness and of prevalence of human rights, particularly regarding the important rediscovery of the right to equality and non-discrimination.
