E-BooksEU Law, Fundamental Rights and National Democracy

EU Law, Fundamental Rights and National Democracy
EU Law, Fundamental Rights and National Democracy By Eduardo Gill-Pedro
2018 | 238 Pages | ISBN: 081538596X | PDF | 2 MB
The orthodox view is that rights complement democracy. This book critically examines this view in the context of EU fundamental rights, specifically in situations where EU law requires member states to respect EU fundamental rights. It first sets out a legal theoretical account of how human rights can complement democracy. It argues that they can do so only if they are understood as both the conditions for the democratic process, and the outcome of such a democratic process. In light of this legal theoretical account of human rights, this book examines the demands which the Court of Justice of the EU (CJEU) imposes on the national orders in respect of EU fundamental rights. The conclusion reached is that the demands which EU fundamental rights impose on national legal orders entail a cost for the democratic legitimacy of those legal orders. Ultimately, accepting the demands of the CJEU in respect of EU fundamental rights may require the national legal order to abandon its commitment to protecting the human rights which are the foundation of the national legal order's very legitimacy.

Brexit Time: Leaving the EU - Why, How and When? By Kenneth A. Armstrong
2017 | 306 Pages | ISBN: 1108415377 | PDF | 2 MB
The result of the UK referendum in June 2016 on membership of the European Union had immediate repercussions across the UK, the EU and internationally. As the dust begins to settle, attention is now naturally drawn to understanding why this momentous decision came about and how and when the UK will leave the EU. What are the options for the new legal settlements between the UK and the EU? What will happen to our current political landscape within the UK in the time up to and including its exit from the EU? What about legal and political life after Brexit? Within a series of short essays, Brexit Time explores and contextualises each stage of Brexit in turn: pre-referendum; the result; the process of withdrawal; rethinking EU relations; and post-Brexit. During a time of intense speculation and commentary, this book offers an indispensable guide to the key issues surrounding a historic event and its uncertain aftermath.

E-BooksAntitrust Federalism in the EU and the US

Antitrust Federalism in the EU and the US
Antitrust Federalism in the EU and the US By Firat Cengiz
2012 | 256 Pages | ISBN: 0415674638 | PDF | 3 MB
The EU and the US are the preeminent examples of multi-level polities and both have highly developed competition policies. Despite these similarities however, recent developments suggest that they are moving in different directions in the area of antitrust federalism. This book examines multi-level governance in competition policy from a comparative perspective. The book analyses how competition laws and authorities of different levels - the federal and the state levels in the US and the national and the supranational levels in the EU - interact with each other. Inspired by the increasingly divergent policy developments taking place on both sides of the Atlantic, the author asks whether the EU and the US can draw policy lessons from each other's experiences in antitrust federalism. Antitrust Federalism in the EU and the US reveals the similarities and differences between the European and American models of antitrust federalism whilst employing policy network models in its comparative analysis of issues such as opacity and accountability in networks. The book is essentially multidisciplinary in its effort to initiate dialogue between the Law and Political Science literatures in this field. This book will be of particular interest to academics, students and practitioners of Competition Law, Constitutional Law and Political Science.
