Justifying Injustice: Legal Theory in Nazi Germany By Herlinde Pauer-Studer
2020 | 225 Pages | ISBN: 110715930X | PDF | 2 MB
Post-war legal scholars commonly consider the Third Reich's judicial system to be the paradigm of 'evil law'. By examining how crucial parts of this distorted normative order evolved and were justified by regime-loyal legal theorists, we can appreciate how law can bend to a political ideology and fail to keep state power from transgressing elementary standards of humanity and the rule of law. From 1933 to 1939, a flood of publications reflected on the question of how to adapt law to the political ends of National Socialism, debating both the normative and constitutional foundations of the National Socialist state, and the proper form and content of criminal and police law in this new political framework. These debates, the main threads of which are central to this book, reveal the normative ideas driving the Führer state and the legal subtext to the Nazi regime's escalating atrocities.

Greed and Injustice in Classical Athens. By Ryan K. Balot
2001 | 280 Pages | ISBN: 069104855X | PDF | 23 MB
In this original and rewarding combination of intellectual and political history, Ryan Balot offers a thorough historical and sociological interpretation of classical Athens centered on the notion of greed. Integrating ancient philosophy, poetry, and history, and drawing on modern political thought, the author demonstrates that the Athenian discourse on greed was an essential component of Greek social development and political history. Over time, the Athenians developed sophisticated psychological and political accounts of acquisitiveness and a correspondingly rich vocabulary to describe and condemn it. Greed figures repeatedly as an object of criticism in authors as diverse as Solon, Thucydides, and Plato--all of whom addressed the social disruptions caused by it, as well as the inadequacy of lives focused on it. Because of its ethical significance, greed surfaced frequently in theoretical debates about democracy and oligarchy. Ultimately, critiques of greed--particularly the charge that it is unjust--were built into the robust accounts of justice formulated by many philosophers, including Plato and Aristotle. Such critiques of greed both reflected and were inextricably knitted into economic history and political events, including the coups of 411 and 404 B.C. Balot contrasts ancient Greek thought on distributive justice with later Western traditions, with implications for political and economic history well beyond the classical period. Because the belief that greed is good holds a dominant position in modern justifications of capitalism, this study provides a deep historical context within which such justifications can be reexamined and, perhaps, found wanting.

The outcry and eruption of protests following Floyd's killing led to a long-overdue reckoning across industries, in politics and in society to confront white supremacy and racial injustice. For Scientific American, part of this reckoning is to make a commitment to improved and wider reporting of racism and to elevate Black and Brown voices. In this eBook, we've gathered some of our most important coverage to date, including how systemic racism is linked to COVID-19 and other public health crises, injustice in law enforcement practices and bias in academia and the scientific community.

In The Experience of Injustice, the French philosopher Emmanuel Renault opens an important new chapter in critical theory. He brings together political theory, critical social science, and a keen sense of the power of popular movements to offer a forceful vision of social justice. Questioning normative political philosophy's conception of justice, Renault gives an account of injustice as the denial of recognition, placing the experience of social suffering at the heart of contemporary critical theory.
